  • Content You Upload: We collect all data, information, text, audio, video, images, files, links, or other materials that you upload, submit, post, create, or otherwise make available to or through the Service ("Content"). This includes:
    • Public Files: Content you designate as "public" or make accessible via a Public Profile URL.
    • Private Files: Content you designate as "private," which may be accessed by our Listed Agent feature.
    • Hidden Files: Content you designate as "hidden." (Please see our Terms of Service for how each type of Content is handled and licensed to us.) You acknowledge that any Content you upload, regardless of its designation (Public, Private, or Hidden), may contain Personal Data. You are responsible for ensuring you have the necessary rights and consents to provide this Personal Data to us for processing as described in this Privacy Policy and our Terms of Service.
  • Payment Information: If you subscribe to a paid plan, we (or our third-party payment processors like Stripe) collect payment and billing information, such as your credit card details and billing address. We do not store full credit card numbers ourselves.
  • Communications with Us: When you contact us for support, provide feedback, participate in surveys, or otherwise communicate with us, we collect the information you provide in such communications.
  • Information for AI Profile Enhancement: We may prompt you for additional information to enhance your AI Profile or the effectiveness of the Listed Agent.

1.2 Information We Collect Automatically When You Use the Service:

  • Log Data: When you access or use our Service, our servers automatically record information, including your Internet Protocol (IP) address, browser type and settings, device information (e.g., operating system, device identifier), the referring/exit pages and URLs, date and time stamps, clickstream data, and language preferences.
  • Usage Data: We collect information about how you use our Service, such as the features you use, the pages you visit, the Content you access or interact with, the frequency and duration of your activities, and other actions you take on the Service.
  • Cookies and Similar Tracking Technologies: We use cookies, web beacons, pixel tags, and similar technologies to collect information about your browsing activities and to distinguish you from other users of our Service. This helps us provide you with a good experience, improve our Service, and personalize content and ads.   • Service Providers: We may receive information about you from our third-party service providers, such as analytics providers or payment processors.
  • Business Users: If you are using the Service on behalf of an organization (e.g., your employer), we may receive information about you from that organization.

2. HOW WE USE YOUR INFORMATION

We use the information we collect for various purposes, including:

2.1 To Provide, Maintain, and Improve the Service:

  • Operating and managing your account and the Service.
  • Hosting your Content (Public, Private, and Hidden Files) and enabling features like the Public Profile URL and the Listed Agent.
  • Processing your payments.
  • Personalizing your experience on the Service.
  • Developing new features, products, and services.
  • Monitoring and analyzing trends, usage, and activities in connection with our Service.
  • Troubleshooting issues, providing customer support, and responding to your inquiries.

2.2 For AI Development, AI Profile Creation, and Commercialization (Our Core Purpose):

This is a primary purpose for collecting and using your information, including all Content (Public, Private, and Hidden Files) and any Personal Data contained therein:

  • Creating AI Profiles and Derivatives: To analyze, process, and transform your Content, often in combination with other data (including publicly available information or data from third parties), to create AI Profiles and other Derivatives as defined in our Terms of Service.
  • Training and Improving AI Models: To train, develop, validate, and improve our own artificial intelligence models, algorithms, and machine learning technologies, as well as those of our trusted third-party partners and customers.
  • Commercialization of Data, AI Profiles, and Derivatives: To sell, license, sublicense, distribute, or otherwise transfer your Content (in raw, aggregated, anonymized, or pseudonymized forms), AI Profiles, and Derivatives to third parties for their own unrestricted use. This includes, but is not limited to, use by businesses, researchers, AI developers, data brokers, or for inclusion in open-source datasets or commercial data products.
  • Research and Analysis: For internal research and analysis, and to enable third parties to conduct research and analysis using your Content, AI Profiles, or Derivatives.

2.3 To Communicate with You:

  • Sending you transactional or administrative messages (e.g., account verification, service updates, security alerts, support messages).
  • Responding to your comments, questions, and requests.
  • Providing you with information about our products, services, features, promotions, and events that we think may interest you (subject to your marketing preferences and applicable law).

2.4 For Security and Fraud Prevention:

  • Protecting the security and integrity of our Service, our users, our data, and our business.
  • Detecting, preventing, and investigating fraud, unauthorized access, and other illegal or harmful activities.

2.5 For Legal Compliance and Protection of Rights:

  • Complying with applicable laws, regulations, legal processes, or governmental requests.
  • Enforcing our Terms of Service and other policies.
  • Protecting our rights, privacy, safety, or property, and/or that of you or others.

2.6 With Your Consent:

  • Public Files: If you designate Content as Public Files and/or share your Public Profile URL, that Content will be accessible to anyone on the internet.
  • Listed Agent: If you enable the Listed Agent feature, AI-generated responses based on your Private Files will be shared with third parties who submit queries.
  • Business User Profiles: Information you provide for a Business User profile may be visible to other users associated with your organization or the public, depending on your settings.

3.4 In Connection with Business Transfers:

We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business by another company. We will notify you of such a change in ownership or control of your Personal Data, if required by law.

3.5 For Legal Reasons and Protection of Rights:

We may disclose your information if we believe in good faith that such disclosure is necessary to:

  • Comply with any applicable law, regulation, legal process, or governmental request (e.g., subpoenas, court orders).
  • Enforce our Terms of Service or other agreements or policies.
  • Protect the rights, property, or safety of Listed AI, our users, or the public from harm or illegal activities.
  • Detect, prevent, or otherwise address fraud, security, or technical issues.

Our license to use your Content for creating Derivatives for sale/license is perpetual and survives termination, which may impact erasure requests concerning such derived data.

Marketing Communications Opt-Out:

  • Whether there is a legal obligation to which we are subject (e.g., certain laws require us to keep records of your transactions for a certain period).
